Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of erem.app and related services (the "Service"), operated by EREM ("EREM", "we", "us", or "our"). By creating an account or using the Service, you agree to these Terms.

1. Eligibility & Accounts

You must be at least 18 years old to use the Service. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Landlord accounts and tenant accounts each have distinct permissions within a shared organization workspace.

2. Description of Service

EREM provides tools for landlords and tenants to manage properties, leases, rent payments, late fees, autopay, work orders, and related documents. Payments are processed by Stripe; EREM does not store full payment card or bank account numbers.

3. Payments & Fees

• Rent and other charges are due as set out in your lease. Amounts, applicable processing fees, and balances are calculated and enforced server-side.
• A payment processing fee may apply depending on payment method (e.g., card vs. ACH), disclosed prior to confirming any payment.
• Late fees may apply per the rules configured on your lease and will never exceed the cap stated in your lease.
• Enabling autopay authorizes EREM to charge your saved default payment method for the remaining balance due after the applicable grace period.

4. SMS / Text Messaging Terms

By opting in to text message notifications, you agree to receive automated SMS messages from EREM related to rent due dates, payment confirmations, and late fee notices at the mobile number you provide.

• Consent is not required to purchase or use the Service; SMS is an optional convenience feature.
• Message frequency varies (e.g., monthly rent reminders and occasional late fee alerts).
• Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.
• Reply STOP to any message to opt out at any time, or disable text reminders from your account profile. Reply HELP for help.
• Supported carriers may change without notice; EREM is not liable for messages that are delayed or not delivered due to carrier issues.

5. Acceptable Use

You agree not to: (a) use the Service for any unlawful purpose; (b) attempt to access accounts, data, or systems you are not authorized to access; (c) upload malicious code; or (d) interfere with the normal operation of the Service.

6. Work Orders & Documents

Tenants may submit maintenance work orders through the Service; landlords are responsible for triaging and resolving them. Documents uploaded to the Service (leases, photos, etc.) remain the property of the uploading party, subject to the access rights described in our Privacy Policy.

7. Termination

We may suspend or terminate access to the Service for violation of these Terms or for any conduct that we believe harms the Service, other users, or third parties.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. EREM does not guarantee uninterrupted or error-free operation of the Service.

9. Limitation of Liability

To the maximum extent permitted by law, EREM shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

10. Governing Law

These Terms are governed by the laws of the United States and the state in which EREM operates, without regard to conflict-of-law principles.

11. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
